PERA admits to OMA violation

An attorney for the state’s Public Employee Retiree Association admitted the board violated the Open Meetings Act at its May meeting. The admission came in response to a compliant FOG filed with New Mexico Attorney General Hector Balderas on Wednesday.

In a letter addressed to the Attorney General, PERA Attorney John Melia wrote, “PERA agrees that the action with regards to AFSCME was not on the meeting agenda and that the Board’s action as it relates to AFSCME dues is therefore void under the Open Meetings Act.”

Melia continued, “Accordingly, PERA will not take any action regarding termination of withholding of AFSCME dues until such time as it is properly noticed on the Board’s agenda in accordance with the Open Meetings Act.”
