If a custodian determines that a written IPRA request is excessively burdensome or broad, an additional reasonable period of time shall be allowed to comply with the request. The custodian must provide the requester notice within 15 days of receipt of the IPRA that additional time will be needed to respond. NMSA 1978 § 14-2-10
If the custodian does not permit the records to be inspected within a reasonable period of time, the person seeking the records can pursue the remedies discussed later in this lesson. NMSA 1978 § 14-2-10
The Act does not define what constitutes an “excessively burdensome or broad request.” The Act also does not define a “reasonable time” for inspection, which may vary according to the request.
