Nothing in IPRA regarding the provision of public data in electronic format limits the ability of the custodian to engage in the sale of a database as authorized by NMSA 1978 § 14-3-15 and 14-3-18, including reasonable restrictions on the use of the database and the payment of a royalty or other consideration. NMSA 1978 § 14-2-9-D
Note, though, that the foregoing statutes does not define a database and considerable disagreement has arisen about what constitutes a database. In addition, some of the restrictions on the use of the database may be unconstitutional to the extent the user must agree not to use the database for political purposes.
