This exception allows a public body to close a meeting in regard to discussion of limited personnel matters such as the hiring, promotion, demotion, dismissal, assignment or resignation or the investigation or consideration of complaints or charges again an individual employee (emphasis added).
Final action in regard to an employee must be taken at an open meeting. Also, the exception allows an aggrieved public employee to demand a public hearing. Judicial candidates interviewed by any commission also have the right to demand an open interview. NMSA 1978 § 10-15-1-H (2)
This exception does not apply to contract employees or general discussions concerning personnel policy.
